This paper examines Jacques Derrida's deconstruction of Giorgio Agamben's account of the history of bio-politics in the Beast and the Sovereign. In this account, the ‘threshold of bio-political modernity’ is identified with the collapse of an allegedly immemorial distinction between life and the law. According to Derrida, however, this in-distinction between life and the law, which supposedly marks the historical emergence of the bio-political, is in fact an originary event. Agamben, therefore, announces a bio-political modernity that has always already existed. (...) In this essay, I argue that Derrida, in the Beast and the Sovereign, fails to grasp the significance of one of the principal figures employed in Agamben's theory of the bio-political, the ‘threshold’. This figure, which Agamben opposes, elsewhere in his writings, to the Derridean notion of difference/deferral, does not refer to either an historical beginning or something that has always already existed. Rather, the threshold is defined as a particular moment in which an originary phenomenon becomes a decisive historical norm. In his ‘history’ of the bio-political, therefore, Agamben identifies the modernity of the latter in terms of the historical normalization of an in-distinction between law and life that has always already occurred. We present an argument-based formalism of contract dispute resolution following a modern view that the court would resolve a contract dispute by enforcing an interpretation of contract that reasonably represents the mutual intention of contract parties. Legal doctrines provide principles, rules and guidelines for the court to objectively arrive at such an interpretation. In this paper, we establish the appropriateness of the formalism by applying it to resolve disputes about performance relief with the legal doctrines of impossibility and frustration of (...) purpose in common laws of contract. Nas sendas deste pensamento, destacamos o papel do povo vietnamita, ligado profundamente ao desenvolvimento sustentável. Todo esforço deve consistir no trabalho de organizar os recursos do povopara desenvolver o país. Nesse sentido, o pensamento de Ho Chi Minh sobre a organização social não deve se valer, apenas, daqueles que participaram da revolução pela independência do Vietnã, mas deve se dar como força motriz para o desenvolvimento sustentável. Isto posto, temos que,junto àideia de desenvolvimento sustentável, é necessário desenvolver outros setores como a economia, a cultura e a sociedade, promovendo o estado de bem-estar social, elevando o Vietnã ao estágio de desenvolvimento de outros países.Nessa toada, o crescimento econômico deve refletir o progresso e a justiça social, traduzido em qualidade de vida e erradicação da pobreza. This paper explores the relationship between revolution and corruption in Jean Genet’s accounts of the Palestinian movement in his final work, Prisoner of Love. For Genet, corruption does not simply expose the actions of a revolutionary subject as an empty impersonation, performed for the actual ends of acquiring personal power and fortune. Rather, it exposes the ‘pretension’ inherent in the revolution it undermines as well as in the accumulation of value. For Genet, the misappropriation of money by the Palestinian leadership (...) makes manifest the imaginary character of both devotion to a revolutionary cause and greed for the commodity-fetish. Corruption, in other words, betrays revolution as well as the ‘imaginary wealth and power’ which the ‘game of revolution’ attempts to destroy. (shrink)

This paper argues for the contemporary significance of the ‘Critique of Violence’ by proposing a Benjaminian reading of two important analyses of the relationship between history, politics and the Rights of Man: Hegel’s account of the French Revolution and the concept of dissensus proposed by Jacques Rancière. For both Hegel and Rancière, the gap between right and reality – between the ideal of equality, for example, and the existence of concrete inequality – does not warrant a rejection of the Rights (...) of Man. Rather, the gap is a constitutive condition of law and political rights. From the perspective of Benjamin’s ‘Critique of Violence’, however, these analyses serve to perpetuate a bourgeois legality, one that both Hegel and Rancière acknowledge can never be realized due to the constitutive discrepancy between right and reality. In preserving the promise of legal equality, these analyses preclude the possibility of a suspension or ‘absolution’ from law. This suspension of law is a task that Benjamin identified with the proletarian general strike, a strategy whose pure violence is supposed to secure what Benjamin described, enigmatically, as a ‘wholly transformed work’. Remarkably, however, the relationship between the suspension of law in a general strike and a total transformation of labour is never clearly defined in the ‘Critique’. This paper will develop an account of this relationship by pursuing the references to Marx’s critical theory of capitalism in Benjamin’s writings. (shrink)

This essay considers Deleuze and Guattari’s paradoxical claim that Marx’s critique of political economy implies as a universal history derived from the singular features of capitalism. In this critique, capitalism is defined by the commodity form, as a relationship of economic equivalence that replaces the bonds of dependence underlying other social formations. By negating relations of kinship and caste, capitalism reveals, a contrario, the universal foundation of other societies. As the “negative of all social formations,” capitalism conditions a universal history, (...) defined, retrospectively, from the singular standpoint of a society, based upon the negation of kinship and caste. In this universal history, moreover, the negation of capitalism is identified with the possibility of a new and equally singular form of society. In Anti-Oedipus, the latter is defined as a “schizophrenic” condition liberated from the commodity as well as from the bonds of dependence that constituted the universal foundation of earlier societies. This article sheds light on the diversity of meanings and connotations that tend to be lost or hidden in translations between different conceptualizations of nature in East and South-East Asia. It reviews the idea of “nature” in Chinese, Japanese, Vietnamese, Filipino, Tagalog, Cebuano, Lumad, Indonesian, Burmese, Nepali, Khmer, and Mongolian. It shows that the conceptual subtleties in the conceptualization of nature often hide wider and deeper cosmological mismatches. It concludes by suggesting that these diverse voices need to be represented in (...) global reports on sustainability, which can be fostered by the direct involvement of experts from diverse traditions of thought who have access and interpretative knowledge of sources in languages other than English. To take into consideration the diversity of conceptualizations of nature can lead to better decisions about sustainability and improve the acceptability and efficiency of environmental policies in each local context, as well as internationally. The principle of mandatory prosecution (MP) is respected, extensively applied, and has a long-standing tradition in continental European countries, and it is highly valued in socialist nations. However, in recent decades, there has been a notable shift in its implementation within these countries, with numerous studies reflecting this change by presenting diverse perspectives on the necessity to alter, modify, or preserve this principle. One of the primary aims of this paper is to examine the scope of research on responses to (...) MP and the main reasons for maintaining or renewing MP highlighted in related publications. This paper employed a systematic literature review (SLR) to search the Scopus and Web of Science (WoS) databases, compiling a total of 28 papers spanning 50 years. These articles cover a wide range of countries and diverse jurisdictions currently applying either MP or discretionary prosecution (DP) principles. Furthermore, the literature review includes various arguments and discussions on how countries should respond to MP. Findings indicate that MP persists due to its enduring values, such as legality and equality, alongside its significant role in safeguarding the criminal justice system against arbitrariness and abuse of power. Our paper also reveals that the tendency to renew or replace MP is influenced not only by conflicting opinions but also by political factors and the consideration of victims’ discretion in certain offenses, particularly in cases of domestic violence. Additionally, three options for reconciling MP and DP principles are proposed to aid readers in understanding the transition process between these two fundamental principles. Ultimately, the paper advocates for further research on MP in current or former socialist countries, where applicable. (shrink)

This paper presents an enhanced ontology formalization, combining previous work in Conceptual Structure Theory and Order-Sorted Logic. Most existing ontology formalisms place greater importance on concept types, but in this paper we focus on relation types, which are in essence predicates on concept types. We formalize the notion of ‘predicate of predicates’ as meta-relation type and introduce the new hierarchy of meta-relation types as part of the ontology definition. The new notion of closure of a relation or meta-relation type is (...) presented as a means to complete that relation or meta-relation type by transferring extra arguments and properties from other related types. The end result is an expanded ontology, called the closure of the original ontology, on which automated inference could be more easily performed. Our proposal could be viewed as a novel and improved ontology formalization within Conceptual Structure Theory and a contribution to knowledge representation and formal reasoning (e.g., to build a query-answering system for legal knowledge). Marine and coastal ecosystems are crucial in maintaining human livelihood, facilitating social development, and reducing climate change impacts. Studies have examined how the benefit perception of aquatic ecosystems, knowledge, and emotion about climate change affect peoples’ support for marine protection. However, their interaction effects remain understudied. The current study explores the intricate interaction effect of the benefit perception of aquatic ecosystems, knowledge, and worry about climate change on marine protection support. Bayesian Mindsponge Framework (BMF) analytics was employed on a dataset (...) of 709 stakeholders from 42 countries generated by MaCoBioS—a research project funded by the European Commission Horizon 2020. The statistical analysis shows that the impacts of benefit perception of ocean ecosystems, knowledge, and worry about climate change on marine protection support vary due to their interactions. Specifically, when stakeholders perceive ocean ecosystems to have little utility in mitigating climate change, greater climate change knowledge and concern are associated with a higher level of marine protection support. Nevertheless, in the scenarios where stakeholders perceive the benefits of ocean ecosystems, the effect of climate change knowledge becomes conditional on the worry level. If stakeholders are concerned about climate change, those with a greater level of climate change knowledge will associate with a higher level of marine protection support. Otherwise, greater climate change knowledge will result in lower support. These findings highlight emotion’s importance in directing climate change knowledge’s effect on marine protection support. Linking people’s “objects of care” to the consequences of climate change can help improve climate change communication effectiveness. (shrink)

Coastal protection is crucial to human development since the ocean has many values associated with the economy, ecosystem, and culture. However, most ocean protecting efforts are currently ineffective due to the burdens of finance, lack of appropriate management, and international cooperation regimes. For aiding bottom-up initiatives for ocean protection support, this study employed the Mindsponge Theory to examine how the public’s perceived economic and cultural values influence their willingness to support actions to protect the ocean. Analyzing the European-Union-Horizon-2020-funded dataset of (...) 709 respondents from 42 countries, we discovered that perceived economic values have negative effects on the tendency of ocean protection supports (i.e., food, transportation, renewable energy, oil and gas, and recreation). In contrast, certain perceived cultural values can help increase the willingness to do so (i.e., mental well-being and sense of identity). However, the effects of perceived cultural values are only moderately reliable. These findings suggest that designing cultural information delivery campaigns can help promote coastal reserve supports, such as fundraisings and preserving the oceans from the community. (shrink)

The nationwide economic reform in 1986 transformed Vietnam from a centrally planned economy to a socialist-oriented market economy. Entrepreneurs and entrepreneurial spirits within the populace are suggested to fuel the structural changes. Despite the importance of entrepreneurship in Vietnam’s economy, studies in Vietnam mainly pay attention to the practical aspects of entrepreneurial activities and neglect the cognitive and theoretical aspects of entrepreneurship. Thus, the current study employs the information-processing perspective of the Mindsponge Theory to explore how entrepreneurs’ knowledge accumulation can (...) affect their perceived likelihood of business success. Bayesian analysis indicates that business-related experience positively affects entrepreneurs’ business success likelihood. Greater willingness/readiness to transform thinking, acting, and beliefs can improve the business success of entrepreneurs who study others’ failures carefully. However, for entrepreneurs who perceive learning from others’ failures as unnecessary, higher willingness/readiness to transform diminishes their chance of success. Based on these findings, we recommend Vietnamese entrepreneurs accumulate knowledge through experience, learning, and an open mind for better decision-making and innovation creation capabilities. The phrase ‘chết phải toàn thây’, which has no direct English translation, can be roughly interpreted as ‘one must die with an intact body’. This belief, deeply rooted in Vietnamese culture, significantly influences how the body is treated after death. It is often linked to the idea that the body must remain whole for the soul to rest peacefully or transition smoothly into the afterlife. While many societies, particularly in the Western world, view the donation of organs after death as (...) a noble act, the belief in ‘chết phải toàn thây’ poses a significant barrier to promoting organ donation in Vietnam. This essay highlights the cultural origins of this belief and explores a broader interpretation of ‘toàn thây’ or ‘intact body’ in the modern era. The phrase ‘chết phải toàn thây’, firmly ingrained in Vietnamese culture for thousands of years, reflects the influence of religious and philosophical traditions, particularly Confucianism, Buddhism and Taoism.1 Confucianism emphasises filial piety (xiao), which includes preserving bodily integrity after death as a sign of respect for one’s parents and ancestors.2 Taoism, with its focus on the soul’s immortality and harmony with nature, regards the body as a sacred vessel crucial for maintaining a balance between the physical and spiritual realms.2 Together, these traditions form a cultural framework that assigns profound spiritual and emotional significance to the body, making its preservation a deeply held …. The digital era brings various benefits to adolescents. However, operating on the digital environment without sufficient knowledge and skills will expose them to multiple types of risks, especially in the country with low digital safety education rate like Vietnam. The current study examines factors that can contribute to cultivating adolescents’ digital resilience using the information-processing reasoning of the Mindsponge Theory. A UNESCO dataset of 1061 Vietnamese high school students was analyzed using the Bayesian Mindsponge Framework analytics. It is found that (...) adolescents’ daily Internet usage frequency, parents’ Internet safety guidance, and teachers’ safety guidance are positively associated with digital resilience. However, the effects of parents’ and teachers’ Internet safety guidance on digital resilience are conditional on the daily Internet usage frequency. Parents’ guidance only enhances adolescents’ digital resilience if they use the Internet less than four hours per day. In contrast, the positive effect of teachers’ guidance on adolescents’ digital resilience becomes stronger when the students spend more time on the Internet (more than 1 hour). Based on these findings, we suggest that adolescents can learn to minimize risks and protect themselves by exposing more to the digital environment. Parents’ and teachers’ supports are important in enhancing adolescents’ capability to deal with digital threats, but types of supports need to be carefully considered to avoid reverse impacts on adolescents’ resilience. Human contact is a key issue in social interactions for autonomous systems since robots are increasingly appearing everywhere, which has led to a higher risk of conflict. Particularly in the real world, collisions between humans and machines may result in catastrophic accidents or damaged goods. In this paper, a novel stop strategy related to autonomous systems is proposed. This control method can eliminate the vibrations produced by a system’s movement by analysing the poles and zeros in the model of autonomous (...) vehicles and goods. Using the pole placement technique, the motion of a system is guaranteed to be more stable, more flexible and smoother. Moreover, several control profiles are employed in the switching mechanism to choose the proper vibration-free effect. The main contributions of this paper are the recommendation of an active stopping planner using different smooth generators from a modelling study, the validation of their physical characteristics and the launching of a switching algorithm based on the socially aware navigation framework of a robot. This theoretical work is based on the virtual environment of MATLAB, and the experiment is implemented in the practical platform of an automated guided vehicle. From these results, it can be seen that the proposed approach is robust, effective and feasible for applications in storehouse management, public transportation or factory manufacturing. (shrink)

The study of cultural evolution has taken on an increasingly interdisciplinary and diverse approach in explicating phenomena of cultural transmission and adoptions. Inspired by this computational movement, this study uses Bayesian networks analysis, combining both the frequentist and the Hamiltonian Markov chain Monte Carlo (MCMC) approach, to investigate the highly representative elements in the cultural evolution of a Vietnamese city’s architecture in the early 20th century. With a focus on the façade design of 68 old houses in Hanoi’s Old Quarter (...) (based on 78 data lines extracted from 248 photos), the study argues that it is plausible to look at the aesthetics, architecture, and designs of the house façade to find traces of cultural evolution in Vietnam, which went through more than six decades of French colonization and centuries of sociocultural influence from China. The in-depth technical analysis, though refuting the presumed model on the probabilistic dependency among the variables, yields several results, the most notable of which is the strong influence of Buddhism over the decorations of the house façade. Particularly, in the top 5 networks with the best Bayesian Information Criterion (BIC) scores and p<0.05, the variable for decorations (DC) always has a direct probabilistic dependency on the variable B for Buddhism. The paper then checks the robustness of these models using Hamiltonian MCMC method and find the posterior distributions of the models’ coefficients all satisfy the technical requirement. Finally, this study suggests integrating Bayesian statistics in the social sciences in general and for the study of cultural evolution and architectural transformation in particular. (shrink)

As conventionally understood, corruption relies on a set of universally agreed rules that determine what constitutes the appropriate allocation of organizational resources. This article explores whether rule-based approaches to corruption are applicable where business organizations, such as public private partnerships, and the public fundamentally disagree about what constitutes an appropriate allocation of resources. Drawing on empirical research about PPPs in Vietnam, this article compares how government, business organizations, and the public conceptualize the transfer of public assets into private ownership. Every year, the Vietnamese people reportedly burned about 50,000 tons of joss papers, which took the form of not only bank notes, but iPhones, cars, clothes, even housekeepers, in hope of pleasing the dead. The practice was mistakenly attributed to traditional Buddhist teachings but originated in fact from China, which most Vietnamese were not aware of. In other aspects of life, there were many similar examples of Vietnamese so ready and comfortable with adding new norms, values, and beliefs, even contradictory (...) ones, to their culture. This phenomenon, dubbed “cultural additivity”, prompted us to study the co-existence, interaction, and influences among core values and norms of the Three Teachings –Confucianism, Buddhism, and Taoism–as shown through Vietnamese folktales. By applying Bayesian logistic regression, we evaluated the possibility of whether the key message of a story was dominated by a religion (dependent variables), as affected by the appearance of values and anti-values pertaining to the Three Teachings in the story (independent variables). Our main findings included the existence of the cultural additivity of Confucian and Taoist values. More specifically, empirical results showed that the interaction or addition of the values of Taoism and Confucianism in folktales together helped predict whether the key message of a story was about Confucianism, β{VT ⋅ VC} = 0.86. Meanwhile, there was no such statistical tendency for Buddhism. The results lead to a number of important implications. First, this showed the dominance of Confucianism because the fact that Confucian and Taoist values appeared together in a story led to the story’s key message dominated by Confucianism. Thus, it presented the evidence of Confucian dominance and against liberal interpretations of the concept of the Common Roots of Three Religions (“tam giáo đồng nguyên”) as religious unification or unicity. Second, the concept of “cultural additivity” could help explain many interesting socio-cultural phenomena, namely the absence of religious intolerance and extremism in the Vietnamese society, outrageous cases of sophistry in education, the low productivity in creative endeavors like science and technology, the misleading branding strategy in business. We are aware that our results are only preliminary and more studies, both theoretical and empirical, must be carried out to give a full account of the explanatory reach of “cultural additivity”. Bribing doctors for preferential treatment is rampant in the healthcare system of developing countries like Vietnam. Although bribery raises the out-of-pocket expenditures of patients, it is so common to be deemed an “envelope culture.” Given the little understanding of the underlying mechanism of the culture, this study employed the mindsponge theory for reasoning the mental processes of both patients and doctors for why they embrace the “envelope culture” and used the Bayesian Mindsponge Framework (BMF) analytics to validate our reasoning. Analyzing (...) responses from 1042 Vietnamese patients, we discovered that bribing doctors can help patients reduce the destitution risk induced by treatment. Such effect of doctor bribery remains consistent among patients that have to pay high daily costs (e.g., accommodation and subsistence fees) regardless of their employment status. Nevertheless, for patients with no or unstable jobs, their risks of destitution increase if they have to pay more thank-you money. These findings suggest that doctor bribery is an adaptive strategy for patients in an environment where the healthcare supply cannot meet the actual demand. Moreover, healthcare equity is greatly exacerbated due to the envelope culture, as vulnerable individuals are exposed to a greater threat of poverty. At the same time, those with good economic conditions get preferential treatment by paying a higher amount of thank-you money. Healthcare workers’ ethics must be the top priority for an equitable and proper healthcare system. (shrink)

Creativity is a crucial aspect of entrepreneurship. However, research on the information processing mechanism of creativity in relation to entrepreneurship is still very limited. To explore factors contributing to creativity performance among entrepreneurs in terms of information processing, we applied the Bayesian Mindsponge Framework. We used the Serendipity-Mindsponge-3D (SM3D) knowledge management theory to construct models and conducted Bayesian analysis on the most comprehensive and well-designed dataset of 3071 Vietnamese entrepreneurs up to date. We found that entrepreneurs who give more time (...) to their startup attempts are likely to have lower levels of creativity. Both factors of higher levels of knowledge within one’s discipline and better connections to out-of-discipline knowledge are positively associated with more creativity. While the effect of openmindedness on the relationship between within-discipline knowledge and creativity is unclear, openmindedness was found to have a positive moderating effect on the association between out-of-discipline knowledge and creativity. These findings support entrepreneurs in understanding the information processing mechanisms behind creativity for creating more effective knowledge management strategies. (shrink)

Humankind is facing many existential global problems that require international and transgenerational efforts to be solved. Preparing our next generation with sufficient knowledge and skills to deal with such problems is imperative. Fortunately, the digital environment provides foundational conditions for children’s and adolescents’ exploration and self-learning, which might help them cultivate the necessary knowledge and skills for future survival. We conducted the Bayesian Mindsponge Framework (BMF) analytics on a dataset of 2069 students from 54 Vietnamese elementary, secondary, and high schools (...) to test this presumption. The results showed that students with higher digital literacy are more curious and have better knowledge regarding global issues (i.e., climate change, disease, overpopulation, aging, etc.). Students’ curiosity also mediates the relationship between digital literacy and global issues knowledge. Based on these findings, we argue that digital explorative space is essential for digital natives’ education for survival, individually (i.e., for future employment requirements) and socially (i.e., for making informed decisions and creating innovations that can be helpful to society). Children’s and adolescents’ exposure to digital explorative space should be promoted to improve their digital literacy rather than prohibition. During the exploration, emotional intelligence is critical in mitigating existential risks, or threats, to digital natives to navigate and overcome chaotic processes occurring in unchartered waters in the virtual world. Air pollution is a considerable environmental stressor for urban residents in developing countries. Perceived health risks of air pollution might induce migration intention among inhabitants. The current study employed the Bayesian Mindsponge Framework (BMF) to investigate the rationale behind the domestic and international migration intentions among 475 inhabitants in Hanoi, Vietnam – one of the most polluted capital cities worldwide. We found that people perceiving more impacts of air pollution in their daily life are more likely to have migration intention. (...) The effect of perceived air pollution impact on international migration intention is stronger than that of domestic migration. Acknowledging a family member’s air pollution-induced sickness moderated the association between perceived air pollution impact and domestic migration intention, while the personal experience of air pollution-induced sickness did not. In contrast, the moderation effect of personal experience of sickness became significant in the international migration circumstance, but the effect of information about a family member’s sickness was trivial. The findings suggest that urban inhabitants’ consideration of air pollution averting strategies reflects some characteristics of Homo Oeconomicus. Additionally, the individual’s socio-economic decision is seemingly insignificant on a social scale. Still, through environmental stressors as catalysts, such decisions might result in considerable social outcomes (e.g., internal migration and emigration). (shrink)

Using a nationwide survey of provincial institutional quality and a sample of private manufacturing small and medium scale enterprises, this paper contributes to the literature by considering for the first time the effects of corruption on the financial performance of Vietnamese private SMEs. Interestingly, contrary to previous findings, we find that corruption when measured by a dummy variable, does not affect firms’ financial performance after controlling for heterogeneity, simultaneity and dynamic endogeneity. However, the intensity of bribery and the majority of (...) the forms of corruption were found to have negative impacts on firms’ financial performance. Hence, a typical approach using only a dummy variable for bribery might not adequately evaluate the impact of bribe intensity or even ignores the negative impacts of some types of bribes on firms’ financial performance. Ao construir um país forte e desenvolvido no Vietnã, estudar os pensamentos de Phan Boi Chau fornece uma perspectiva abrangente sobre questões econômicas, políticas e sociais, encontrando assim soluções apropriadas para enfrentar os desafios modernos no contexto da globalização e garantindo um desenvolvimento sustentável e harmonioso. Este estudo, portanto, examina o (...) pensamento patriótico e as atividades revolucionárias de Phan Boi Chau (1867–1940), um proeminente pensador e ativista vietnamita no início do século XX. Empregando métodos materialistas dialéticos, analítico-sintéticos e históricos, a pesquisa investiga o papel de Phan Boi Chau na inspiração da luta vietnamita contra o colonialismo francês e sua evolução ideológica do confucionismo para princípios democráticos e socialistas. As descobertas revelam a liderança de Phan Boi Chau em movimentos como Duy Tan Hoi, Dong Du e Vietnam Quang Phuc Hoi, destacando sua ênfase estratégica em educação, esclarecimento e renascimento nacional. Apesar das limitações de seu caminho para a salvação nacional, as ideias e esforços de Phan Boi Chau criaram a base para movimentos revolucionários posteriores. O legado de Phan Boi Chau inspira patriotismo, resiliência e desenvolvimento intelectual na trajetória de desenvolvimento moderna do Vietnã. (shrink)

Crime victims are forgotten in criminal proceedings. Criminal justice systems tend to treat crime victims quite poorly, but, when they deal with child victims, their frequent failure to respect the child’s rights finds no excuse. Law enforcement and criminal justice interventions made in the name of protecting children against violent crime often fail to consider what is truly in the best interests of the child and end up further victimizing the child victims. Vietnam has instituted justice reforms that recognize the (...) need for special measures to protect the rights of child victims and witnesses of crime. This article reviews the progress achieved in implementing these reforms and points at several areas where implementation has been slow or further reforms are needed. Based on a comparative legal analysis, the article exemplifies how legal semiotics can contribute to an understanding of the complexity of policy transfer in the area of justice and human rights. Thomas Aquinas persistently defended the idea that the soul survives physical death. But what exactly is the rational soul that becomes separated from the body at death? When a person’s body dies, do they cease to exist? Over the past few decades, a nuanced debate has developed between “survivalists” and “corruptionists” over whether or not a separated soul is still a person, leading to impenetrable disagreements in which neither side can seem to sway the other. This study of two of Newman’s Anglican sermons—“The Christian Mysteries” (1829) and “The Mystery of the Holy Trinity” (1831)—shows that he considered the doctrine of the Trinity to be the foundation of Christian faith. Simultaneously, this study highlights the biblical and patristic underpinnings of Newman’s Trinitarian theology, while showing that he was defending Trinitarian orthodoxy from both “classical heresies” and contemporary Liberalism and Rationalism.

The article focuses on the study of workplace learning for hospital’s staff to become mortuary care agents. It is based on the analysis of verbalizations obtained from self-confrontations interviews made with the mortuary care trainees. These interviews are extracted from video recordings taken while trainees carry out their normal task. The goal is to identify, within the context of the interaction between trainees and tutors, signs of learning progress in the trainees’ verbalizations, which could be linked to existing hospital standards. As demonstrated by the activity clinic methodology, these verbalizations are not just a simple depiction of the work activity as it happened but serve as an experiment to underline the learning benefits for the trainees. Beyond the benefits of better understanding the trainees work tasks, the resulting analyses indeed support the formative aspect of self-confrontation interviews. In this perspective, the article focuses on a methodological aspect, the data analysis to account for signs of learning such as verbalized and recognized by the trainees in their interactions with tutors. On the occasion, we question the formative dimension of this methodological setting in the prospect of designing training devices for these professionals. (shrink)

This sermon-study—a sequel to a previous study of Newman’s theology of the Immanent Trinity, 1829–1834 (NSJ 7/1: 73–86)—examines Newman’s theology of the Trinity in the economy of salvation. Viewing the mystery of the Incarnation as the Revelation of Theologia in Oikonomia, Newman developed a “theology of glorification” and a “theology of within-ness,” which in turn grounded a “theology of Rest and Peace.” Newman’s Trinitarian theology (1835–1841), which was deeply influenced by the Fathers of the Church, was simultaneously his response to (...) the anti-dogmatic Liberalism that rejected Christ’s divinity and so denied the Trinity. Controversies arise over abortion, assisted dying and conscientious objection in healthcare. The purpose of the study was to examine the relationship between attitudes towards these bioethical dilemmas, and secularity and religiosity. Data were drawn from a 2017 web-based survey of a representative sample of 1615 Norwegian adults. Latent moderated structural equations modelling was used to develop a model of the relationship between attitudes. The resulting model indicates that support for abortion rights is associated with pro-secular attitudes and is a main (...) “driver” for support for assisted dying and opposition to conscientious objection. This finding should be regarded as a hypothesis which ought to be tested in other populations. If the relationship is robust and reproduced elsewhere, there are important consequences for CO advocates who would then have an interest in disentangling the debate about CO from abortion; and for health systems who ought to consider carefully how a sound policy on CO can safeguard both patient trust in the services and the moral integrity of professionals. It is suggested that if religiosity wanes and pro-secular and pro-abortion attitudes become more widespread, support for CO might decline, putting into question whether present policies of toleration of conscientious refusals will remain acceptable to the majority. Research over the past four decades has built a convincing case that co-speech hand gestures play a powerful role in human cognition. However, this recent focus on the cognitive function of gesture has, to a large extent, overlooked its emotional role—a role that was once central to research on bodily expression. In the present review, we first give a brief summary of the wealth of research demonstrating the cognitive function of co-speech gestures in language acquisition, learning, and thinking. Building on (...) this foundation, we revisit the emotional function of gesture across a wide range of communicative contexts, from clinical to artistic to educational, and spanning diverse fields, from cognitive neuroscience to linguistics to affective science. Bridging the cognitive and emotional functions of gesture highlights promising avenues of research that have varied practical and theoretical implications for human–machine interactions, therapeutic interventions, language evolution, embodied cognition, and more. Recent conversation has blurred two very different social epistemic phenomena: echo chambers and epistemic bubbles. Members of epistemic bubbles merely lack exposure to relevant information and arguments. Members of echo chambers, on the other hand, have been brought to systematically distrust all outside sources. In epistemic bubbles, other voices are not heard; in echo chambers, other voices are actively undermined. It is crucial to keep these phenomena distinct. First, echo chambers can explain the post-truth phenomena in a way that epistemic (...) bubbles cannot. Second, each type of structure requires a distinct intervention. Mere exposure to evidence can shatter an epistemic bubble, but may actually reinforce an echo chamber. Finally, echo chambers are much harder to escape. Once in their grip, an agent may act with epistemic virtue, but social context will pervert those actions. Escape from an echo chamber may require a radical rebooting of one's belief system. As mounting evidence highlights the human-driven extinction of avian species, reconnecting people with nature—particularly these feathered creatures—has become essential for engaging the public in conservation and the preservation of avian biodiversity. Paradoxically, heightened awareness of the benefits birds bring has fueled the rise of aviary bird-keeping for entertainment in Vietnam. This paper seeks to unravel the absurdity of bird keepers who claim to love nature and support conservation while engaging in practices that exploit and commodify birds for human interests. By (...) contrasting the values generated by birds in aviaries with those in their natural habitats, it underscores the role of an eco-deficit culture—or, more fundamentally, humanity's insatiable greed—in fostering this absurd form of "nature love.". As global warming is gradually pushing the Earth to the climate tipping point, the reduction of CO2 concentration in the atmosphere has become more urgent than ever. Many high-tech methods, such as Carbon Capture and Storage (CCS) technologies, have been proposed as crucial tools in the fight against climate change. However, this paper argues that the expensiveness and uncertainty of CCS technologies make them not feasibly deployed. Persistent investment in these technologies also reinforces the outdated eco-deficit mindset that prioritizes monetary (...) over environmental values. In contrast, the recent flood in the Sahara desert turned barren areas green, reminding us that nature, when given the opportunity, can have an astonishing capacity to heal itself. Investing billions of dollars in deploying costly and uncertain high-tech solutions while limiting funds for local communities to take care of reliable natural carbon sinks risks depleting humanity's resources to tackle climate change, especially when the tipping points are closed. Diversity, equity, and inclusion (DEI) policies and programs are crucial tools for reducing social inequality within organizations. However, the recent decline in DEI practices and the inconsistencies found in existing research underscore the need for new theoretical approaches. This essay seeks to offer a fresh perspective on the strengths and limitations of DEI initiatives through the lens of granular interactions thinking theory. It posits that while DEI policies and programs generally create conditions conducive to greater value creation and improved adaptability (...) to changing environments and challenges, maintaining direction and operational certainty within an organization with high DEI demands significant energy investment. To sustain DEI and enhance its effectiveness, these policies need to go beyond simply increasing diversity and ensuring equal access to opportunities. They must also focus on empowering a diverse workforce to contribute to the organization’s success actively. Additionally, fostering a workplace culture that enhances members’ adaptive cognitive processing and skills can reduce the energy required to sustain DEI efforts, making these practices more sustainable in the long term. Through the lens of the informational entropy-based notion of value, I attempt to provide explanations for the aspects of cultural additivity that I could not explain previously: the additivity limit and the drawbacks of cultural additivity.

Globally, the COVID-19 pandemic is triggering a public health emergency and crisis on a large scale, with far-reaching effects and severe damage to all aspects of politics, economy, cultural and social life, and health. Consecutive outbreaks over the past nearly 2 years of “living with COVID-19” have forced most schools to physically close, resulting in the largest educational disruption in human history. In turbulent times of the COVID-19 crisis, school leaders are facing numerous major challenges germane to school governance and (...) leadership. The key objective of the study is to fully explore the prospective challenges principals are encountering in public schools in times of COVID-19. To fulfill the research purpose, a systematic literature review was carried out to investigate the leadership challenges. As a result, a total of 24 challenges were explored through SLR approach. Frequency analysis approach was initially applied to figure out the most significant challenges. Accordingly, seven challenges were found statistically significant as showing frequency ≥ 50 each. Irrevocably, the study works as a contribution to K-12 school leadership by providing guidance for current and future leaders in crisis based on practical investigation, experiences, and recommendations. Policy makers can leverage these findings to make necessary adjustments to school policy to better prepare school leaders for crisis. Additionally, the findings of the current study are believed to have profound implications for future research. These findings expand our current understanding on school leadership in time of crisis that needs further investigation. Subsequent studies can quantitatively and/or qualitatively validate these leadership challenges findings regarding a particular school context. (shrink)

In Vietnam, patriotism is the highest value in the nation's spiritual value system. Patriotic feelings were formed from the very beginning of the founding of the country and continue to grow strongly to this day. It soon became the reason for life, the ideal, and the belief in the spiritual life of the Vietnamese people. The purpose of this paper is to provide a comprehensive and in-depth view of patriotism as a specific philosophy of the Vietnamese nation. To that end, (...) the paper focuses on analyzing what patriotism is and its expressions. It discusses the basic tenets of Vietnamese patriotism: the spirit of independence, self-reliance, the sense of national self-reliance, solidarity in national construction and defense and a humanistic spirit. Market crises amplify fear, disrupting rational decision-making of stock investment. This study examines the relationship between investors’ information priorities—such as intuition, company performance, technical analysis, and other factors—and their fear responses (freeze, flight, and hiding) during market crashes. Using the Bayesian Mindsponge Framework (BMF) to analyze data from 1,526 investors in China and Vietnam, the findings reveal complex dynamics. We found positive associations between investors’ prioritization of social influence and intuition for investment decision-making with being freeze (i.e., not knowing what (...) to do with the owned stock), between prioritization of professionals’ evaluation and intuition with fleeing (i.e. giving up stock investment permanently), and between prioritization of professionals’ evaluation and social influence with hiding (i.e., stopping investing in stock for a while). In contrast, prioritization of companies’ performance metrics (e.g., net profit, debt, etc.) was negatively associated with being freeze, fleeing, and hiding. Meanwhile, prioritization of professionals’ evaluation, technical analysis, and liquidity was negatively associated with being freeze, fleeing, and hiding, respectively. The study highlights the importance of disseminating transparent, accurate information through government and media channels, along with implementing financial education programs, to promote rational investment decisions and reduce fear-driven behaviors.
